Question: How can I get the car dealership to take a car back that they got financed for me using forged documents?
Sept 01, 2005
Hello Tony
I bought a car yesterday. I was mad when I bought it so I signed for a loan with 18% interest!
Because of my profession, I did not have proof of income. The dealership made up a check stub to fool the bank. Now that I am not mad anymore and I have thought things through better, I realize that the entire deal is bad all the way around.
How can I make the dealership take the car back, cancel the loan and give me my $2300 down payment back?
I appreciate it,
Holly
Answer:
Hi Holly,
If they arranged a loan with a bank or loan company for you, and they got you approved using a falsified check stub they are
committing fraud.
Tell them to cancel the deal and give you your money back or you will tell the loan company and you will contact your state's Attorney General's office and file a complaint for fraudulent practices.
What they did is illegal. Still, if they want to be stubborn about it you may have to fight to get your money back. You may even want to consider getting a lawyer to sue them.
Good luck . . . and try to control that temper!
All my very best...

Additional Comments From Holly:
I very much appreciate the advice. I went back the next morning to try to get everything canceled and get my money back. I decided I should secretly bring in a tape recorder just in case they deny the fake check stub, which they did when things got heated.
Luckly, I did not have to use the recording, they do not even know I have it. When I went back, I brought my fiance. We think that they did this because I am a young girl and I am a first time
buyer.
We stood our ground and they quickly gave me my money back and canceled the loan. Needles to say, now that I know that is illegal, I will not be doing business there again!
Thank you so much,
Holly
My Final Comments:
Good work getting your money back. In their minds they think they were doing you a favor by getting you financed. Of course, they didn't take into consideration that they could all go to jail and the dealership could be closed down and put out of business . . . but anything to get the sale!
