Question: How do I get my $1,000 deposit back and cancel a car deal I made at a car dealer?

Hi Tony

Three days ago I paid $1,000 cash on my car. I realized that I didn't want the car so I tried to take it back the next morning. My salesman won't take it back and he won't return my phone calls.

I have contacted the finance company and asked them no to finance it. Within a three day period I purchased another car and used the same finance company. The salesman is refusing to give me my money back or take my car. The car is not insured. I refuse to insure it, and the financial company will not pay for the car and it cannot be added to my insurance.

The salesman also went to the dealership where I purchased the new car from and threw the key in the front seat and locked the door, saying that it's my car. So the new car company actually towed the car. No one will contact me back from Toyota, but from my knowledge the agreement cannot be binding because I signed paper work for Professional to finance their car and they won't.

So I have no financing for this car. Professional is actually financing the new car for me. Is the first contract still binding? Can I return the old car since there is no financing for this car?

Answer:

Hi Enjoli,

I cannot give you legal advice since I am not a lawyer. I have no way of knowing how legally binding the contracts are that you signed regarding financing and so forth. You should contact the owner of the first dealership right away and explain the situation. Forget the salesman. All he cares about is saving his commission!

The owner of the dealership can very easily reverse the deal, give your money back and let you off the hook. You'll just have to convince him to do so. If you can't get anywhere with him then I would suggest you consult with a lawyer as soon as possible to determine exactly what your rights are before this whole mess gets totally out of hand.
